Privacy Policy
This Privacy Policy is effective as of June 16th, 2006
Turn Inc. ("Turn") provides advertisers and publishers (or their agents) ("Web Partners") access to a set of technologies and processes designed to display advertisements to consumers viewing a publisher's website(s) (the "Turn Ads").
Below, please find a description of how Turn strives to protect the privacy of (i) consumers that view and/or interact with a Turn Ad ("Users"), (ii) visitors to our website ("Web Visitors"), and (iii) our Web Partners. This Privacy Policy may be updated from time to time for any reason. We will notify you of any material changes to our Privacy Policy by posting the new Privacy Policy on the Turn website (our "Site"). Your use of our Site and our services constitutes your acceptance of the terms of this Privacy Policy as amended or revised by us, and you are advised to consult this Privacy Policy regularly for any changes.
1. Consumers Who View Turn Ads
Information. Except incidentally as described below, Turn does not collect personally identifiable information (such as name, username, address, phone number or email address) from Users viewing or interacting with Turn Ads. Notwithstanding the foregoing, Turn does collect a User's IP address and information that is specific to how Users access and use the Internet as well as how they view and/or interact with Turn Ads: these non-personally identifying details include, but are not limited to, the website a User is logged onto, the geographic location of the IP address the User is using to access the Internet, the type of browser used, which and how many web pages have been viewed by the User, search terms used, referring/exit pages, platform type and date/time information.
Incidental Receipt of Personal Information. Turn displays Turn Ads on publishers' web pages based on the content of those pages. It simply-and automatically-matches the words on a page to an appropriate Turn Ad. Sometimes a publisher sends Turn a page that includes a User's personally identifiable information. As an example, if a User edits his California address on a music website's shipping page, Turn might display an Ad for the song, "California Dreaming." Turn will not use personally identifiable information for any other purpose.
Purpose. Except for personal information collected incidentally (see above), the information Turn collects about Users is anonymous and does not personally identify a User. It is obtained for the purpose of delivering Turn Ads and measuring their effectiveness with Users. Turn aggregates this information and uses it to analyze trends, identify the audience most likely to respond to an advertisement and to tailor advertisement placement for our Web Partners accordingly. This aggregated information may be shared with Turn's affiliates, advertisers, employees, customers and Web Partners. Turn reserves the right to track IP addresses for the purposes of fraud prevention, and Turn reserves the right to release IP addresses to legal authorities.
Cookies. Turn uses cookies to help it collect, maintain and use this information. A cookie is a small data file that Turn transfers to a User's computer's hard disk for record-keeping purposes when the User is served an advertisement facilitated by Turn. Cookies help Turn better understand the effectiveness of a Turn Ad (for example, by tracking the way in which a User responds to, selects and interacts with a Turn Ad or any content provided therein, or the location and context in which a User views a Turn Ad). Turn's cookies do not contain any personally identifiable information and they can help control the number of times a User views an advertisement. Most Internet browsers automatically accept cookies. A User can instruct his/her browser, by editing its options, to stop accepting cookies or prompt the User before accepting a cookie from the sites s/he visits. If a User does not accept cookies, however, a User may not be able to use all portions of the website which s/he is visiting or all functionality of the services offered. Web Beacons. Turn also uses web beacons, in combination with cookies, to analyze usage patterns of Users. A web beacon is typically a transparent graphic image (usually 1 pixel x 1 pixel) or a piece of Javascript code that is placed on a webpage. The use of a web beacon allows Turn to record that the User has visited that particular webpage, along with particular non-personally identifiable information that the advertiser may choose to include with the beacon, such as the dollar amount of a shopping transaction completed by the user. Advertisement Links. Turn Ads may contain links to other websites, including those of our Web Partners. Such websites may use cookies and/or other data collection tools. Turn is not responsible for the privacy practices, policies or the content of such websites. Turn encourages Users to read the posted privacy policies whenever interacting with any website to learn more about the privacy practices of that website. Turn has no control over the use of a User's personal information by third party websites, and a User should exercise caution when deciding to disclose any personally identifiable information.
Turn does not have access to, or control of, the cookies and/or other data collection tools that may be placed on any advertisement by a third-party, including those of our Web Partners, and this Privacy Policy does not cover the use of cookies and/or other data collection tools by any third party.
2. Visitors to the Turn Website
The Site, which may be hosted in part or its entirety by a third party, is intended primarily to offer information about Turn and the services it provides. The Site is designed so that a Web Visitor may generally browse it without the collection of any personally identifiable information (except for the Web Visitor's IP address). When a Web Visitor uses the Site, Turn may collect information indirectly and automatically (through the use of cookies and web beacons, as described above) about the Web Visitor's Site activity. Turn uses this activity information for internal purposes such as to administer the Site, improve and customize the Site, help Turn understand and analyze how the Site is being used and to track aggregate Site usage.
The Site may contain links to other websites. Such websites may use cookies and/or other data collection tools. Turn is not responsible for the privacy practices, policies or content of such other websites. Turn encourages its Web Visitors to read the posted privacy policies whenever interacting with any website to learn more about the privacy practices of that website. Turn has no control over the use of a User's personal information by third party websites, and a User should exercise caution when deciding to disclose any personally identifiable information.
The Site may provide an opportunity for Web Visitors to contact Turn. If you contact Turn, such contact information (including email addresses) and the content of any communication will be collected and used by Turn in order to respond to the communication and send any relevant or requested information.
The Site permits Web Partners to log into their Accounts and access the Web Partner Services. See Section 3 below for further information.
The Site is not intended for persons under the age of eighteen (18). If you are under eighteen (18), please do not use the Site.
3. Account Holders: Our Web Partners
This section of the Privacy Policy applies only to information our Web Partners (Turn advertisers and publishers who enter into separate respective Advertiser and Network Participation agreements with Turn) may provide to Turn during their registration with Turn as a Web Partner and their creation of a Web Partner account (an "Account"), and in conjunction with their access to, participation in and use of the Turn advertising network and related Turn technology and services (including but not limited to the Turn Site portal) (collectively, the "Web Partner Services"). To become a Web Partner, you must be at least eighteen (18) years old and otherwise capable of forming legally binding contracts under applicable law.
Turn is committed to maintaining the privacy of its Web Partners.
Collection and Use of Web Partner Information
Account Information. During Account registration, Turn will collect personally identifiable information from a Web Partner that may include name, company name, address, email address, telephone and fax numbers, Account password, bank information, credit-card type, number and expiration date, domain address for serving Turn Ads, PayPal email address, social security number and/or Federal Tax ID number and other personal information listed in the Account registration form (collectively, a "Profile").
Purpose. Turn's primary goal in collecting a Web Partner's Profile is to communicate with such Web Partner, provide it with a smooth and efficient experience of Web Partner Services and to charge advertisers and pay publishers. To this end, Turn may share Profiles with third-party service providers and Turn-related entities worldwide (e.g., its parents, affiliates and subsidiaries and their successors and assigns) in connection with communications, payments and other aspects of operating and promoting the Site and the Turn advertising network. We require that these entities agree to use such information based on our instructions and in compliance with this Policy and any other appropriate confidentiality and security measures. Except as explicitly stated herein, Turn does not sell, rent or trade any Profiles to third parties.
Use. Turn may use a Profile in the following ways:
(a) Turn may use a Web Partner's name, address, email address and telephone number: (i) to enable Turn to process, validate and verify an Account; (ii) to contact the Web Partner regarding Account activities or communications relevant to Web Partner Services; and (iii) to contact the Web Partner about new or existing products and services or special offers.
(b) Turn may use a publisher's: (i) name, address, account password, bank information or credit-card number in order to process and remit fees to publisher and/or verify personal information and identity of the publisher; and as appropriate (ii) social security number and/or Federal Tax ID number to prepare Form 1099s if necessary and to help Turn verify such Web Partner's identity.
(c) Turn may use an advertiser's: (i) name, address, account password, bank information or credit-card number in order to process and charge fees to advertiser and/or verify personal information and identity of the advertiser; and as appropriate (ii) social security number and/or Federal Tax ID number to prepare Form 1099s if necessary or to help Turn verify such Web Partner's identity.
(d) Turn uses third-party processing companies (including credit card processing companies) for billing and payment purposes. These third parties may store or retain a Web Partner's personally identifiable information. Turn may charge or bill a Web Partner's credit card an initial Account activation fee as described during the Account registration process. In certain cases, Turn will also use credit card information to help verify Web Partner's identity. These third parties do not have any right to use the Profile information Turn provides to them beyond what is necessary to assist Turn.
(e) Turn may combine the information collected from Web Partners on the Site with information that Web Partners provide to Turn in connection with their use of other Turn products and services.
(f) Dispute Resolution. Turn may use and disclose Profiles and other information Turn obtains from a Web Partner's current and past activities on the Site in special circumstances, if Turn is required to do so, if Turn reasonably believes that such disclosures will potentially mitigate its liability, or for Turn to enforce its rights. For example, Turn may disclose Profiles: (i) to appropriate authorities and to banks associated with a Web Partner's Account in order to prevent or report suspected fraud and illegal activities; (ii) where it is necessary for Turn to enforce the applicable Web Partner agreements; (iii) to resolve disputes, including disputes involving other Web Partners or consumers, in connection with actual or potential parties to a lawsuit or actions that Turn is or may become involved in, and to identify potential liabilities and troubleshoot problems; or (iv) in order to prevent harm to any persons. In some cases, the government can compel the disclosure of information about a Web Partner, and Turn will need to comply, in which case Web Partner authorizes Turn to do so.
(g) Surveys. From time to time Turn may ask Web Partners to participate in surveys. These surveys are entirely voluntary and a Web Partner may decline to participate. If you choose to provide some of your Profile information in response to a survey, such information will be used for purposes of monitoring or improving the Site or the use and satisfaction of the Turn services.
(h) Cookies. Turn automatically collects a Web Partner's IP addresses and website usage information when a Web Partner logs into their Account or while using Web Partner Services. Turn may collect information indirectly and automatically (through the use of cookies, as described above) about the Web Partner's Site activity. Turn uses this activity information to help Turn evaluate how its Web Partners use and navigate the Site on an aggregate basis, including the number and frequency of Web Partner visits, and the length of their visits. Turn also uses the non-permanent session cookie to track and maintain a web partner's login status during their session on the site. Turn also uses this information for internal purposes, such as to help Turn diagnose any server problems, administer the Site, improve and customize the Site, or help Turn understand and analyze how the Site is being used. Turn may link IP addresses to certain personally identifiable information only when reasonably necessary to satisfy any applicable law, regulation, legal process or enforceable governmental request, enforce applicable Web Partner agreements, including investigation of potential violations thereof, or detect, prevent or protect Turn against or otherwise address criminal activity, fraud, security or technical issues.
(i) Storing and Processing Profiles. Profiles collected during a Web Partner's use of the Web Partner Services may be stored and processed in any country in which Turn maintains facilities. Consequently, Turn has the right to transfer information outside of a Web Partner's country, and you consent to such transfer. If a Web Partner registers an Account on any website controlled by Turn or a Turn-related entity located outside of the United States, such Profile must be disclosed to Turn, which is located inside the United States, in order for the Web Partner to access or use any Web Partner Services. Therefore, Web Partner acknowledges and consents to the sharing of its Profile with Turn and Turn-related entities worldwide.
Opt-Out. If a Web Partner does not wish to receive communications from Turn as contemplated under this Privacy Policy, such Web Partner has the ability to stop receiving these mail communications by logging into their Account and accessing the "Account Settings" screen in the Turn Site portal. Web Partner will, however, always receive administrative emails from Turn that are related to Web Partner Services.
Correcting/Updating Web Partner Information. Web Partners can review, update and edit their Profile by logging into their Account and accessing the "Account Settings" screen in the Turn Site portal.
Transaction History. A Web Partner may unsubscribe from the Web Partner Services and request that Turn remove their Profile from the Turn databases. However, in order to resolve disputes, assist with any applicable law, regulation, legal process or governmental requests or investigations, and due to technical constraints (including the fact that Turn backs up its systems), a Web Partner's information and transaction history are never completely removed from the Turn databases.
Security. Turn stores Profile information in limited access servers. Turn will maintain safeguards to protect the security of these servers and the Profiles. Although Turn strives to keep Profiles secure, no security measures are absolute or fool-proof, and there is always a possibility that a security breach could occur, resulting in the release of Profile information.
Other Information. If you send Turn email correspondence, or if consumers or other third parties send Turn email or other correspondence regarding a particular Web Partner's activities, Turn may collect such information.
4. General:
If any or all of the assets of Turn are acquired by, or merged with another entity, we will share some or all of the information described in this Privacy Policy with this entity.
Turn may also use third-party advertising companies to serve or track ads on the Site and other websites, including the websites of our Web Partners. Such companies may use information (not including your name, address, email address or telephone number) about your visits to these websites in order to measure advertising effectiveness and to provide advertisements about goods and services that may be of interest to you.
